Terms of Use
These Terms of Use ("Terms") are a binding agreement between you and SanctuaryApp, Inc. ("Marrow", "we", "us") governing your use of the Marrow application and website (the "Service"). By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to use the Service. By using it, you represent that you are 18 or older and able to form a binding contract.
2. What Marrow is, and is not
Marrow offers self-guided tools (such as urge-surfing and grounding exercises, reflective prompts, a step companion, and optional anonymous peer rooms) and an AI companion, intended to support the daily work of recovery. Marrow is not a substitute for professional medical care, diagnosis, treatment, therapy, counseling, or emergency services. Nothing in the Service is medical advice. Always seek the advice of a qualified health professional with any questions about a medical or mental-health condition, medication, detox, or tapering. Never disregard or delay professional advice because of something you read or were told in Marrow.
3. No reliance for emergencies
The Service is not designed or intended for use in emergencies. It cannot summon help, and it may be unavailable, delayed, or inaccurate. Do not rely on Marrow if you are in crisis. In an emergency, contact 911, 988, or your local emergency number immediately.
4. The AI companion
Marrow's companion ("Heron") and AI-assisted features are generated by artificial intelligence using a third-party model. AI can be wrong, incomplete, or inappropriate, and its responses are not reviewed by a clinician before you see them. The companion does not know you, cannot diagnose or treat you, and is not a licensed professional. Use your own judgment, and treat its words as a supportive prompt, not as advice you should act on without consideration. See our Privacy Policy for how your messages are processed.
5. The Grove and community content
If peer rooms ("the Grove") are available to you, they are anonymous spaces for mutual support. You are solely responsible for what you post. You agree not to post content that:
- names a source for, offers to sell or buy, or gives instructions for obtaining or using drugs;
- encourages or glorifies self-harm or substance use;
- harasses, threatens, hates, or targets any person, or shares anyone's private or identifying information;
- is spam, advertising, or otherwise unlawful.
Posts are screened for safety, and we may remove content or restrict access at our discretion, but we do not pre-approve every post and are not responsible for content others share. Peer support is not professional advice. By posting, you grant us a non-exclusive, royalty-free license to host, display, and moderate your content to operate the Service.
6. Your responsibilities
You agree to use the Service lawfully and only for your own personal, non-commercial recovery support. You agree not to misuse it, interfere with its operation, attempt to reverse-engineer or overload it, or use it to harm others.
7. Disclaimer of warranties
The service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, secure, error-free, or that any content or AI output is accurate, reliable, or suitable for your situation.
8. Limitation of liability
To the fullest extent permitted by law, in no event will Marrow, SanctuaryApp, Inc., or its owners, employees, or providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or for any injury, relapse, or harm, arising out of or relating to your use of, or inability to use, the service or any AI output or community content, whether based in contract, tort, negligence, strict liability, or otherwise, even if advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability for all claims relating to the service will not exceed the greater of the amount you paid us for the service in the twelve months before the claim, or one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you, and nothing in these Terms limits liability that cannot be limited by law.
9. Indemnification
You agree to indemnify and hold harmless Marrow and SanctuaryApp, Inc. and its providers from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or of any law or the rights of another.
10. Third-party services and links
The Service links to third-party resources (such as 988, SAMHSA, AA, NA, SMART Recovery, and findtreatment.gov) and relies on third-party providers (such as hosting and AI). We are not responsible for third-party services, their content, or their availability, and your use of them is governed by their own terms.
11. Changes, suspension, and termination
We may modify or discontinue the Service, or any feature, at any time. We may update these Terms; material changes will be reflected in the "Last updated" date and, where appropriate, a more prominent notice. Continued use after a change means you accept the new Terms. We may suspend or end your access if you violate these Terms.
12. Governing law and disputes
These Terms are governed by the laws of the State of Tennessee, United States, without regard to conflict-of-laws rules. Please read this section carefully; it affects how disputes are resolved.
Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court, and either party may seek injunctive relief for misuse of intellectual property. You and Marrow agree that each may bring claims only in an individual capacity, and not as a plaintiff or class member in any class or representative proceeding. If this class-action waiver is found unenforceable, the rest of this section will not apply. You may opt out of arbitration within 30 days of first accepting these Terms by emailing us at hello@martori.studio with the subject "Arbitration opt-out"; opting out will not affect any other part of these Terms.
13. Miscellaneous
If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, with the Privacy Policy, are the entire agreement between you and us regarding the Service.
